  1. Introduction
    1.1 Acceptance of These Terms
    By registering for, accessing, or using the Tower Patrol websites, applications, and related services (the “Services”), you agree to these Terms of Use (“Terms”). These Terms form a legally binding agreement between you and Tower Patrol (“Tower Patrol,” “we,” “us,” or “our”).

If you do not agree to these Terms, do not access or use our Services.

These Terms incorporate by reference our Privacy Policy and Cookie Policy (together with these Terms, the “Agreement”).

1.2 The Services
The “Services” include the sites, products, and other offerings we provide, including but not limited to:

a. Tower Patrol websites, pages, portals, accounts, or channels accessible through any internet or wireless-enabled device (each, a “Website”)
b. Mobile applications
c. Events, demos, or gatherings we host or sponsor
d. Any online platforms operated by Tower Patrol
e. Any pages or applications created or powered by Tower Patrol

Registered users are “Members.” Unregistered users are “Visitors.” Members and Visitors are collectively “Users.”

By using the Services, you represent that you have read and agree to be bound by this Agreement to the exclusion of all other terms, unless Tower Patrol has signed a separate written agreement with you that expressly governs your purchase or use of paid services.

1.3 Modifications to These Terms
We may update these Terms from time to time in our sole discretion. Changes are effective when posted and apply to all continued use of the Services. If you do not agree to an update, you must stop using the Services and, if applicable, close your account.

You are expected to check this page periodically for updates.

  1. Your Obligations
    2.1 Access to the Services
    The Services are owned and operated by Tower Patrol. We may change, suspend, or discontinue all or any portion of the Services at any time, including features, content, or availability, without notice or liability.

You are responsible for:

a. Making all arrangements needed to access the Services
b. Ensuring that anyone using your internet connection to access the Services is aware of and complies with these Terms

If you are asked to provide information to register or access certain features, you agree that all information you provide will be accurate, current, and complete. Your submission of information is governed by our Privacy Policy.

We may disable any username, password, or other identifier at any time in our sole discretion, including if we believe you violated these Terms.

2.2 Eligibility
You must be 18 years or older to use our Services.

Minors who are at least 13 years old may use the Services only through an account owned by a parent or legal guardian, with permission and under direct supervision. Children under 13 are not permitted to use the Services.

Accounts registered with false information may be suspended or terminated. This Agreement is void where prohibited by law.

If you create an account, you agree to:

b. Not transfer your account to any third party

  1. Fees, Billing, and Payment
    3.1 Paid Services
    Tower Patrol may offer certain paid services on a subscription basis (“Subscription Services”) or as one-time purchases (together, “Paid Services”). By purchasing Paid Services, you agree to pay all applicable fees and taxes.

We may use third-party payment processors. You authorize us (and our processors) to charge your chosen payment method for Paid Services fees, taxes, and any recurring charges you approve.

3.2 Subscription Billing and Cancellation
Unless otherwise stated in a written order form or service agreement:

a. Subscription fees are billed on a recurring basis according to the subscription term you select
b. You may cancel a subscription through your account settings or by contacting us
c. If you cancel, you will continue to have access through the end of your current billing period, and you will not receive a refund or credit for fees already paid or due

We may change subscription pricing with at least 30 days’ notice. Continued use after notice means you accept the updated pricing.

3.3 Fraud Prevention and Payment Verification
We reserve the right to refuse, cancel, or limit transactions if we cannot verify payment details or suspect fraud, misuse, or unlawful activity. We may also suspend your access to the Services.

You agree not to conceal identity for transactions through multiple email addresses, identities, or other deceptive methods.

3.4 Notices and Messages
You agree that we may provide notices to you through:

a. The Services or Website
b. Email or other contact information you provided

You agree to keep contact information accurate and up to date.

    4.1 Ownership and Intellectual Property
    The Services and all materials on or within them (including text, graphics, software, video, audio, designs, logos, and other content) (collectively, “Content”) are owned by Tower Patrol or its licensors and are protected by intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or exploit any Content except as expressly permitted by these Terms.

You may:

a. Temporarily store copies in RAM incidental to accessing Content
b. Use cached browser files for display enhancement
c. Print or download a reasonable number of pages for personal, non-commercial use

You may not:

a. Modify copies of materials
b. Use graphics, photos, video, or audio separately from accompanying text
c. Delete proprietary notices
d. Use any part of the Services for commercial purposes unless expressly permitted in writing

4.2 Trademarks
Tower Patrol names, logos, product and service names, designs, and slogans are trademarks of Tower Patrol or its affiliates or licensors. You may not use them without prior written permission. Other trademarks belong to their respective owners.

  1. User Submissions and Feedback
    5.1 User Submissions
    If you submit content, materials, or information through the Services (“User Submissions”), you grant Tower Patrol a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, host, store, reproduce, modify, create derivative works from, publish, and display such User Submissions solely as necessary to operate, improve, and promote the Services, unless otherwise agreed in writing.

You represent and warrant that you own or have the rights to submit User Submissions and to grant the license above.

We may remove User Submissions at any time for any reason, including suspected violations of these Terms.

5.2 Feedback
If you provide suggestions or feedback, you grant Tower Patrol a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate that feedback without compensation to you.

  1. Other Users’ Content
    You understand that other Users may submit content through the Services and that Tower Patrol is not responsible for the accuracy, legality, or appropriateness of third-party content. Your interactions with other Users are at your own risk.

  2. Automated Processing
    We may use data to provide recommendations, improve features, and enhance the Services. Keeping your account accurate helps improve these outputs.

  3. Availability; Storage
    We do not guarantee that any Content will remain available. We have no obligation to store or provide copies of Content unless required by law or stated in our Privacy Policy.

  4. Third-Party Services
    The Services may link to third-party websites, products, or services (“Third-Party Services”). Your use of Third-Party Services is at your own risk and is governed by those third parties’ policies. Tower Patrol is not responsible for Third-Party Services and disclaims liability arising from your use of them.

  5. Restrictions and Acceptable Use
    You agree not to use the Services in a way that:

a. Violates any law or regulation
b. Infringes intellectual property or privacy rights
c. Is harmful, fraudulent, deceptive, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
d. Distributes malware or harmful code
e. Attempts to gain unauthorized access to systems
f. Scrapes, spiders, or uses automated tools to extract data
g. Reverse engineers or attempts to obtain source code
h. Overloads, disrupts, or interferes with the Services
i. Sends spam or mass unsolicited communications
j. Impersonates any person or entity

We may restrict, suspend, or terminate access for violations or suspected misuse.

  1. Warranty Disclaimer
    The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted or error-free.

  2. Indemnification
    You agree to defend, indemnify, and hold harmless Tower Patrol and its affiliates, officers, directors, employees, and service providers from any claims, damages, liabilities, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Submissions, or your violation of this Agreement.

  3. Limitation of Liability
    To the maximum extent permitted by law, Tower Patrol will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill.

In any event, Tower Patrol’s total liability for any claim will not exceed the greater of $100 or the amount you paid to Tower Patrol for the applicable Paid Services in the 12 months preceding the claim.

  1. Disputes Between Users
    Tower Patrol is not obligated to become involved in disputes between Users. You release Tower Patrol from claims arising out of disputes with other Users or third parties.

  2. Termination
    You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you violated these Terms or misused the Services.

Sections that by their nature should survive termination will survive, including payment obligations, ownership, disclaimers, indemnity, and limitation of liability.

  1. Governing Law; Venue
    These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. You agree that any dispute will be brought exclusively in state or federal courts located in Utah, and you consent to personal jurisdiction and venue there.

  2. Miscellaneous
    If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in effect. This Agreement is the complete agreement between you and Tower Patrol regarding the Services, unless a separate signed written agreement controls a specific paid engagement.
